Terms and Conditions

By accessing and using GenCartoon (gencartoon.com, "the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

GenCartoon is an AI platform that turns text prompts and photos into cartoon videos, images and series. The Service includes but is not limited to:

• AI-generated cartoon videos from text prompts
• Photo-to-cartoon images
• Cartoon characters, episodes, series and short movies made in the Studio
• Content storage and management
• User account management

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or transmit viruses or malicious code
• Spam, phish, or send unsolicited messages
• Interfere with or disrupt the Service or servers
• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity
• Collect or store personal data about other users

Community guidelines. GenCartoon has no tolerance for objectionable content or abusive users. Cartoons and comments that are sexual, violent, hateful, harassing, that put children at risk, that are spam or scams, or that infringe someone's copyright or trademark are not allowed.

In the app, signed-in members can report any cartoon or comment (⋯ → Report) and block any person (⋯ → Block, undone in Account → Blocked users): you no longer see the cartoons and comments of someone you block, and they no longer see your comments. We review reports within 24 hours. Content that breaks these rules is removed, and accounts that post it may be suspended or closed (see Termination). A cartoon or comment reported by several people, or reported as a child-safety concern, is hidden from everyone at once while we review it. You can also write to [email protected].

Your Content: You retain all rights to content you create using the Service. By using the Service, you grant us a license to host, store, and display your content as necessary to provide the Service.

Our Content: The Service and its original content (excluding user-generated content), features, and functionality are owned by the operator of GenCartoon and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You acknowledge that content generated by our AI service may:

• Not always be accurate, appropriate, or as expected
• Require human review and editing
• Be subject to the limitations of AI technology

You are solely responsible for reviewing, editing, and using AI-generated content appropriately.

Paid plans are subscriptions, billed monthly or yearly in advance at the price shown at checkout. A subscription renews automatically at the end of each period until you cancel it. Some plans are sold as one-time passes for 30 days or 12 months that do not renew. Credit packs are one-time purchases, available while you have an active plan. Payments are processed by Stripe.

Generating cartoons, images and Studio scenes uses credits from your balance. Credits have no cash value: they cannot be sold, transferred to another account or exchanged for money. How long credits last:

• Monthly plans: your plan's credits are renewed at the start of each billing month. Plan credits left from the previous month do not carry over.
• Yearly plan: the plan's monthly credits are added every month of the paid year, and unused ones carry over within that year. Plan credits left at the yearly renewal expire.
• Credit packs: sold only while you have an active plan, and used after your plan's credits. Each pack lasts 2 months to 2 years depending on its size, as shown before you buy; buying a pack moves all the pack credits you hold to the later date. Pack credits work only while your plan is active: when it ends they are paused, and they come back if you subscribe again before they expire.
• Passes: where a plan is sold as a pass, it is one payment for 30 days or 12 months and never renews. Its credits can be used until the pass ends; plan credits left when it ends expire.
• When a plan ends: the plan credits left on it expire on that date.
• Failed generations: if a cartoon, image or scene fails to generate, its credits are returned to your balance.

You can cancel a subscription at any time from Settings. It stays active until the end of the period you have already paid for and is not charged again. Cancelling does not refund the current period.

All payments are final and non-refundable, except in the cases listed in our Refund Policy, which forms part of these Terms: duplicate charges, renewals charged after you cancelled, our own billing errors and purchases whose credits were never delivered, reported within 14 days of the charge, or where the law of your country requires a refund.

To the maximum extent permitted by law, GenCartoon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or the like that may be transmitted to or through the Service

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. GenCartoon expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

These Terms shall be governed and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
